This indenture made this 22 day of July, 1910 between Newman Potts & wife Mary
Potts of the first part and Mrs. J. C. Broadhurst of the second part of the
county of Wayne and State of North Carolina to them paid, the receipt of which is
hereby acknowledged, have bargained and sold and by these presents do convey unto
the said party of the second part and her heirs a certain tract of land lying in
Brogden Township, Wayne County, in said State and bounded as follows:
A certain tract of land containing 56 acres more or less being lot No. 5 in the
division of Newman Potts dec’d recorded in Book No. 54 page 44 in the office of
the Register of Deeds of Wayne County.
To have and to hold the aforesaid tract of land to the said party of the second
part her heirs and assigns forever. And the parties of the second part her heirs,
executors, administrators and assigns that they are seized of said premises in
fee that the same are free from all encumbrances and that they will warrant and
defend said title of the same against the lawful claims of all persons. The
condition of the Deed is that whereas the said parties of the first part are
justly indebted to the said parties of the second part in the sum of five hundred
and sixty five dollars by their note bearing interest at 6 per cent per annum
from this date and due July 22, 1911 interest payable annually date herewith, and
are honestly desirous or securing the payment of the same.
Now therefore if the said parties of the first part shall pay off and discharge
said debt and the interest accruing thereon, then this deed shall be void. And
it is furrther understood and agreed that, in case the said parties of the first
part shall fail to pay off said note and interest when due, then all of said notes
and interest when due then all of said notes to become due and payable at once and
the party of the second part or her assigns, is authorized and empowered to
advertise said tract of land at the court-house door and three other public
places in Wayne County and in a newspaper published in said county for thirty
days and after such advertisement sell the same for cash at the court-house door
in Goldsboro and convey the same by deed to the purchaser and out of the proceeds
of such sale pay the said debt at interest and all necessary expense of making
and executing this trust; and the balance remaining she shall pay over to said
Newman Potts or his legal representatives.
In witness whereof the said parties of the first part have hereto set their hands
and seals.
