To the Superior Court of said County:

We, the undersigned Commissioners appointed by the Court to divide and make partition of lands between among Mary C Jones, Wm Potts, Susan M Jones, Newman Potts, Hannah M Stafford, Lucuis Potts, Cintha A Fields, Erbin Potts, Julia E Potts & Minnie C Potts, heirs at law and tenants in common in the following described tracts of land, to wit:

First, beginning at a bridge across a ditch on a path & runs with said path N 64 50 E 55.07 chs (chains) to a pine - then N 19 5 E 41.37 chs to a bay on the run of Poplar branch: then up said branch about 1.50 chs to the mouth of Spring branch - then up the same it meanders to a pine at the head of the said branch - being on the Goldsboro & New Berne road - then with said road as it meanders southwardly to a pine stump - then N 88 15 W 21.63 chs to a stake - then S 3 45 W 38.00 chs to a stake in a field on the run of Marsh branch - then N 72 15 W 20.15 chs to a pine stump: then N 87 15 W 4.67 chs to a pine stump by a path - then S 60 45 W 35.68 chs to a stake: then N 19 20 W 39.33 chs to the first station, containing three hundred and seventy two acres.

The second tract beginning at a stake on the Spring bank and Dudley road & runs then with same N 53 15 Et 11.66 chs to the New Berne road: then with the same S 61 15 E 32.03 chs to a stake on said road near a path that leads off from said road - then S 34 W 4.45 chs to a stake formerly a pine - then S 6 21 W 36.72 chs to a stake & pine stump - then W 15 chs to a black gum on the west edge of a prong of Sleepy Creek - then up said creek as it meanders to another prong of S Creek - then up said North prong as it meanders to a black gum - then N 7 W 23.70 chs to the first station, containing one hundred & forty one & seven tenths acres.

Third tract beginning at a large sweet gum in W F Patricks line & runs then with his line S 89 3 W 7.00 chs to a stake Patricks corner - then S 8 30 W 11.00 chs to a stake Cobbs corner - then S 88 30 W 33.00 chs to a stake - then S 1 30 E 5.40 chs to a stake - then S 47 30 E 32.00 chs to a stake - then N 47 30 E 62 poles - then S 43 E 13 poles to a stake Grady's corner - then with their line N 8 30 E 127 poles to the first station, containing eighty & three fourths acres - that descends to them from their father Newman Potts decd and described in the petition for partition: being duly sworn to do equal right & justice between the claimants proceeded on the 11th day of Dec 1884 to view said estate & set apart to the claimants their respective shares thereof by metes & bounds and hereinafter given, that is to say:

Lot No. 1 is assigned to Erban Potts in severalty, bounded as follows - to wit: beginning at a stake on the New Berne road, corner of Lot No. 2 & runs with the line of said lot S 64.50 W 33.42 chs to a pine - then N 19.51 E 41.37 chs to a bay on the run of poplar branch - then up the run of said branch about 1.50 chs to the mouth of Spring branch - then up the same as it meanders to a pine on the New Berne road at the head of said branch - then with said road as it meanders southwardly to the first station, containing sixty one (61) acres, valued at three hundred and seventy five dollars.

Lot No. 2 is assigned to Minnie C Potts in severalty, bounded as follows - to wit: beginning at a stake on the New Berne road, corner of lot no. 1 & runs then with the line of said lot no. 1 S 64.50 W 33.42 chs to a pine, continued S 64.50 W 55.07 chs to a bridge across a ditch - then S 90.20 East about 7.50 chs to a stake, corner of lot no. 4 - then N 64.45 E 39.25 chs to a stake, corner of lots no. 3 & 4 - then N 25 W 5.00 chs to a stake, corner of lot no. 3 - then S 25 E 3.50 chs to a stake, corner of lot no. 3 - then N 64.15 E 38.20 chs to a stake in the New Berne road - then with said road as it meanders northwardly to the first station, containing fifty five & one half acres, valued at three hundred & fifty dollars.

Lot No. 3 is assigned to William Potts in severalty, bounded as follows - beginning at a stake on the New Berne road, corner of lot no. 2, and runs then with the line of N 2 S 64.15 W 38.20 chs to a stake, corner of lot no. 2 - then N 25 W 3.50 chs to a stake, corner of lot no. 2 - then S 64.50 chs W 10.00 chs to a stake, corner of lot no. 4 - then N 60 E 46.45 chs to a stake on the New Berne road, corner of lot no. 4, then with said road northwardly to the first station, containing twenty five acres valued at three hundred & seventy five dollars.

Lot No. 4 is assigned to Susan M Jones in severalty, bounded as follows - beginning at a stake on New Berne road, corner of lot no. 3 & runs thence S 60 W 46.45 chs to a stake, corner of lot no. 3 - then N 25 W 5.00 chs to a stake, corner of lot no. 2 - then S 64.44 E 39.25 chs to a stake, corner of lot no. 2 - then S 9.20 E 8.50 chs to a stake, corner of lot no. 5 - then with said road, as it meanders northwardly to the first station, containing fifty six & three fourths acres, valued at three hundred & forty five dollars.

Lot No. 5 is assigned to Newman Potts in severalty, bounded as follows: beginning at a stake on the New Berne road, corner of lot no. 4 and runs thence with said road southwardly to a pine stump then N 88.15 W 21.63 chs to a stake - then S 3.45 W 4.00 chs to a stake, corner of lot no. 6 - then S 65 W 66.50 chs to a stake, corner of lot no. 6 - then N 9.20 W 5.75 chs to a stake, corner of lot no. 4 - then N 64.30 E 86.75 chs to the first station, containing fifty six & three fourth acres, valued at three hundred and seventy five dollars.

Lot No. 6 is assigned to Cintha A Fields in severalty, bounded as follows - to wit - beginning at a stake, corner of lot no. 5 & runs then with the line of said lot, S 65 W 66.50 chs to a stake, corner of lot no. 5 - then S 9.20 E 8.75 chs to a stake, corner of lot no. 7 - then with the line of said lot N 15.45 E 64.00 chs to a stake, corner of lot no. 7 - then N 3.45 E 10.25 chs to the first station, containing fifty seven acres, valued at three hundred & fifty dollars.

Lot No. 7 is assigned to Julia E Potts in severalty, bounded as follows, to wit - beginning at a stake, corner of lot no. 6 & runs then S 3.45 W 23.75 chs to a stake on the Marsh Branch - then N 72.15 W 20.15 chs to a pine stump - then N 87.15 W 4.67 chs to a stake - then S 60.45 W 35.68 chs to a stake - then N 9.20 W 8.83 chs to a stake, corner of lot no. 6 - then with the line of said lot N 65.45 E 64.00 chs to the first station, containing fifty eight acres, valued at three hundred & eighty dollars.

Lot No. 8 is assigned to Lucious Potts in severalty, bounded as follows - to wit - beginning at a black gum on the run of a prong of Sleepy creek, Robert's corner & runs then N 7 W 23.70 chs to a stake in the Spring Bank road - then with said road N 53.15 E 11.66 chs to the New Berne road - then with the same S 61.15 E 13.94 chs to a stake, corner of lot no. 9 - then with the line of said lot S 8.30 W 38.50 chs to a pine in the run of a prong of Sleepy Creek - then up the same as it meanders to a north prong - then up said prong as it meanders to the first station, containing sixty five acres, valued at three hundred & thirty five dollars.

Lot No. 9 is assigned to Hanah M Stafford in severalty, bounded as follows, to wit - beginning at a pine on the run of a pine, on the run of a prong of Sleepy creek, corner of lot no. 8 & runs then with the line of lot no. 8, N 8.30 E 38.50 chs to a stake on the New Berne road - then with said road S 61.15 E 18.09 chs to a stake - then S 34 W 4.45 chs to a stake formerly a pine - then S 6.21 W 36.72 chs to a stake & pine stump - then West 15 chs to a black gum on the west side of a prong of Sleepy creek - then up the same as it meanders to the first station, containing seventy one & seven tenths acres, valued at three hundred & thirty five dollars.

Lot No. 10 is assigned to Mary C Jones in severalty, bounded as follows, to wit - beginning at a large sweet gum in Wm F Patrick's line & runs then S 89.3 W 7.00 chs to a stake, Patricks corner - then S 8.30 W 11.00 chs to a stake - then S 88.30 W 33.00 chs to a stake - then S 1.30 E 5.40 chs to a stake - then S 47.30 E 32.00 chs to a stake - then N 47.30 E 62 poles - then S 43 E 13 poles to a stake, Grady's corner - then with their line N 8.30 E 127 poles to the first station, containing eighty & three fourths acres, valued at three hundred & seventy five dollars.

We further charge the more valuable dividends with such sums of money respectively to be paid to those of inferior value as will make an equitable division - that is to say:

Lot No. 1 assigned to Erban Potts pays to Lot No. 2 assigned to Minnie C Potts the sum of nine & one half dollars & also pays to Lot No. 4 assigned to Susan M Jones, the sum of six dollars.

Lot No. 3 assigned to Wm Potts pays to Lot No. 4 assigned to Susan M Jones the sum of eight & one half dollars & also pays to Lot No. 6 assigned to Cinthia Fields the sum of seven dollars.

Lot No. 5 assigned to Newman Potts pays to Lot No. 6 assigned to Cinthia Fields the sum of two & one half dollars - also pays to Lot No. 8 assigned to Lucius Potts the sum of thirteen dollars.

Lot No. 7 assigned to Julia E Potts pays to Lot No. 8 assigned to L. Potts the sum of eleven & one half dollars also pays to Lot No. 9 assigned to Hanah M Stafford the sum of nine dollars.

Lot No. 10 assigned to Mary C Jones pays to Lot No. 9 assigned to Hanah M Stafford the sum of fifteen & one half dollars.

This in our judgement is an equitable division & partition of said lands. Respectfully submitted under our hands & seals: This December 15th, 1884.

The Commissioners appointed to make partition of the lands described in the petition having filed their report & there being no exceptions thereto said report, is in all respects confirmed & is ordered to be recorded & registered.

It is also ordered that the petitioners pay the costs of this proceeding in equal proportions and the costs of each petitioner shall be a lean on his share of said lands until the same shall be paid.
