Newman Potts Deed to Richard & Thomas Mozingo, 1883

Know all men by these presents that I Newman Potts of the County of Wayne and state of North Carolina am held and firmly bound unto Richard Mosingo and Thomas Mosingo in the sum of Five thousand dollars to the true and faithful payment of which I bind myself, my heirs and assigns firmly by these presents. Signed with my hand, and sealed, this October 2’d 1880. The condition of the above obligation is such that whereas the above bounden Newman Potts has agreed to bargain and sell to Richard Mosingo and Thomas Mosingo and their heirs a certain tract of land in the County and state aforesaid in Indian Springs Township on the North side of Neuse River, being a part of the William Cobb lands and bounded as follows beginning at a sweet gum on the river at Stanton’s corner, and runs thence S. 65 W. 95 poles to a stake in a big slough thence S. 60 W. 26 poles to a stake in on a ditch; thence S 70 W 60 poles to a stake on the edge of a slough, then S 64 W 112 poles to a stake at the end of the mill dam, then S 40 ½ W 15 poles to a stake then N 27 W 23 poles to a stake; then N 41 ½ E 362 poles to a stake on Grantham’s line; then his line N 27 W 48 poles to a large gum near a ditch on Patricks line then his line N 88 W 34 poles to a stake his corner, thence his line N 65 W 100 poles to a pine on the river his lower corner, then down the river to the first station, containing one hundred & ninety acres more or less. I said Newman Potts have agreed to sell said land at the price of twenty five hundred dollars (the conditions of the proposed sale is fully described in a written agreement which the said Rich’d Mosingo & Thomas Mosingo have this day executed to me). I have taken five notes of bonds bearing even date with this proper and due November 1st annually and all bearing eight per cent interest and I the sd. Newman Potts bind myself my heirs and assigns on receiving the full amount of said notes which is $500.00 each, with the lawful interest (which is 8%) which may have accrued therein, (provided it be tendered at or before each note respectivelly falls due) to make or cause to be made at my own cost & charges to the sd. Richard Mosingo & Thomas Mosingo a good and sufficient deed of conveyance with general warranty then the obligation to be null & void, otherwise to remain in full force & effect

This Deed, made this 6th day of December 1883, by Newman Potts & Wife Susan Potts of Wayne County, and State of North Carolina to Richard Mozingo & Thos. Mozingo of Wayne County, and State of North Carolina Witnesseth: That said Newman Potts & Wife Susan Potts in consideration of Twenty five Hundred Dollars, to them paid by Richard Mozingo & Thos. Mozingo the receipt of which is hereby acknowleged, have bargained and sold, and by these presents do bargain, sell and convey the said Richard & Thos. Mozingo their heirs, executors, administrators and assigns, a tract or parcel of land in Wayne County, State of North Carolina adjoining the lands of Thomas H. Stanton, George H. Grantham, L.C. Patrick and others, bounded as follows, viz: [description of property is difficult to read but should be the same as above] To Have and to Hold the aforesaid tract or parcel of land and all priviledges and appurtenances thereto belonging, to the said Richard Mozingo & Thos. Mozingo their heirs and assigns, to their only use and behoof.
And the said Newman Potts & Wife Susan Potts covenant that they are seized of said premises in fee, and have right to convey the same in fee-simple, that the same are free from all incumbrnaces, and that they will warrant and defend the said title to the same, against the claims of all persons whatsoever.

I, A.T. Grady, C.S.C. do hereby certify that Newman Potts and Susan Potts his wife, personally appeared before me this day, and acknowledged the due execution of the annexed deed, and the said Susan Potts being by me privately examined, separate and apart from her said husband, touching her voluntary execution of the same, doth state that she signed the same freely and voluntarlily, without fear or compulsion of her said husband, or any other person, and that she doth still voluntarily assent thereto. Let it be registered.
