George & Lizzie Grantham Deed to Newman Potts, 1874

This Indenture made this the first day of January A.D. 1874 between George H Grantham & wife Lizzie H Grantham of the first part & Newman Potts of the second part all of the State of North Carolina Wayne County.

Witnesseth that the said party of the first part for and in consideration of the sum of three hundred and sixty one dollars & forty cents to them said in hand hath bargained sold & conveyed and by these presents doth bargain sell and convey to the said Newman Potts & his heirs and assigns forever & his and their own proper use & behoof in fee simple the following tract or parcels of land bounded as follows being & lying in the State & county afforesa’d.

The swamp tract bounded as follows Beginning at the mouth of a ditch and runs thence N 41 1/2 & 97 poles to a stake thence 27 E 34 poles to a holly tree thence south 60 w 26 poles to a stake near a gate thence s 70 w 60 poles to the beginning containing two and seven twentyeths acres be the same more or less.

The up lands bounded as follows Beginning at the end of the Mill dam and runs thence s 41 ˝ w 150 poles to a stake thence N27 w 23 poles to a stake thence N 41 1/2 E 162 poles to the head of a ditch thence S 17 w 28 poles to the beginning containing fourteen acres be the same more or less. And the said party of the first part for themselves their heirs and assigns hereby warrant and forever defend the above bargained premises from the lawvul claims of any and all persons whatever. Be it remembered that on this 21st day of January AD 1873 before the undersigned Judges of Probate for said County personally came Geo H Grantham and Lizzie H. his wife, the persons described in and who signed the foregoing deed and acknowledged the due execution thereof by them as their act and deed. And thereupon the said Lizzie H. being by the undersigned privately examined separate and apart from her said husband touching her free consent in the execution thereof does declare that she executed said deed fully of her own free will and accind without force fear or other undue influence of her said husband or of any other person and does still voluntarily assent thereto. Therefore let said deed together with this certificate be registered.
