State of North Carolina County of Wayne - Court of Pleas & Quarter Sessions Nov'r Term 1839
Writ of Dower Land - To the worshipful the Justices of said Court:

The petition of Mary McKinne humbly complaining therewith unto our worships that sometime in the month of [blank] in the year of our Lord 1839 John McKinne departed this life intestate leaving him surviving your petitioner his widow.

Your petitioner further represents that said John McKinne left children and heirs at law the following persons Bryant McKinne and Hepsy McKinne who are of lawful age and Mary, Robert, Sarah and David McKinne who are infants under the age of 21 years and who have no guardian.

Your petitioner further shews that her said husband died seized and possessed of a certain tract of land in said county containing about 300 acres adjoining the lands of George Collier, William Carraway and Junius G. Slocumb which descended to his said heirs at law subject to your petitioners right of dower.

Your petitioner prays of your worships to issue a writ of Dower directed to the Sheriff of said county commanding him to summon a jury of good and lawful men to proceed to the premises to allot and lay off her dower by metes and bounds according to law and such other and further relief grant as your petitioner may of rights and in law ask and as in duty bound she will ever pray &c.

This plan represents the lands of John McKinne dec'd in Dower to Mary McKinne his widow. The dotted lines from figure 1 at the end of the Mill dam to 2..3..4..5..6 and 7 at the head of Short Branch then Short Branch to 8 then to 9 on Carraway's Creek then the run of sd Carraway's Creek to the beginning shew the dower this 18th Dec'r 1839. Benajah Herring, Clk. (Note: In the 1842 division of John's land this area appears to be included in lots drawn by the children).

In obedience to an order of Court passed Nov Term 1839 we the undersigned jurors have been summoned and sworn by Wm Thompson Sheriff of said county to lay off to Mary McKinne widow of John McKinne dec'd one third part of the lands of sd dec'd died seized and possessed of and have proceeded as the above plan represents given under our hands and seals this 18th Dec'r 1839. Witness Wm Thompson Shff.
